What is duty drawback and how can my company recover import duties when goods are exported?

Duty drawback is a U.S. Customs program that allows importers to recover most or all of customs duties, taxes and certain fees paid on imported merchandise when that merchandise (or merchandise made with it) is subsequently exported or destroyed under CBP supervision. For U.S. importers, drawback can often recover up to 99% of the duties paid — a meaningful cash-recovery opportunity if you import inputs that later leave the country as finished goods or are re-exported.

Practical steps to pursue drawback: 1) Identify eligible imports and exports: map your bill-of-materials and tariff classifications so you can link imported inputs to exported products. 2) Choose the right drawback type: common categories include unused merchandise drawback (unused imports re-exported), manufacturing drawback (imports used to manufacture exported goods), and rejected/destroyed merchandise drawback. Each has different proof and timing requirements. 3) Maintain airtight documentation: keep customs entry numbers, commercial invoices, packing lists, bills of lading/AES filings, manufacturing records, and proof of export or destruction. 4) Consider substitution rules early: substitution (using “commercially interchangeable” merchandise) is allowed but requires careful compliance with CBP rules—plan SKUs and inventory controls accordingly. 5) Calculate cost vs. benefit: factor in administrative costs, potential bonding, and the anticipated refund rate; some claims can take several months to more than a year to process. 6) File properly with CBP and meet statutory deadlines—drawback claims are time‑sensitive.
